This website, fiftyboutique.com (the "Site"), is operated by Fifty Boutique. Throughout the Site, the terms "Fifty Boutique", "we", "us" and "our" refer to the legal seller identified in Section 1. By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), including the policies referenced in them (such as our Shipping Policy and Refund Policy). If you are a consumer in the European Union, nothing in these Terms limits or replaces your statutory consumer rights; those rights apply in addition to these Terms and prevail over any conflicting provision.

2. Eligibility

By using the Site and placing an order, you confirm that you are at least the age of majority in your country of residence and that you will use the Site and our products only for lawful, personal purposes.

3. Product Information

We make every reasonable effort to display our products, their colours, measurements and descriptions accurately. Colours may appear differently depending on your screen, and garments made of natural fabrics and finished by hand may show minor variations in colour, texture and measurements that are characteristic of such materials and craftsmanship. Nothing in this section limits your rights under the legal guarantee of conformity (Section 12).

4. Product Availability

All products are offered subject to availability. We may limit quantities per customer or per order and may discontinue any product at any time. If an item you have ordered turns out to be unavailable, we will inform you without undue delay and refund the amount paid for that item.

5. Pricing

All prices are shown in euro (EUR) and include free standard shipping to all EU countries. Any customs or import charges are addressed in Section 9. We may change prices at any time; changes apply only to future orders and never to orders already confirmed. If a price is manifestly incorrect due to a technical or typographical error, we may correct the error and, where an order has already been placed at the incorrect price, cancel that order and issue a full refund, informing you promptly.

6. Orders

Your order constitutes an offer to purchase. A contract is formed when your payment has been successfully processed and we have sent you an order confirmation by e-mail. We may refuse, cancel or limit any order where we reasonably suspect fraud or abuse, where there is an error in the price or product information, where the product is unavailable, or where we suspect purchase for commercial resale. If we cancel an order after payment, we will refund the full amount paid without undue delay.

7. Payments

We accept the payment methods displayed at checkout, including major payment cards, digital wallets, PayPal, Bancontact and MobilePay. You confirm that you are authorised to use the chosen payment method and that the billing information you provide is accurate. Payments are processed by third-party payment providers under their own terms; we do not store your full card number on our systems.

8. Shipping and Delivery

Orders are dispatched from our fulfilment location in Türkiye. Delivery methods and estimated delivery times are set out in our Shipping Policy; estimates are indicative only. Unless we have expressly agreed a different delivery time with you, we will deliver the goods no later than 30 days after the conclusion of the contract. If we fail to deliver within that period, you may require us to deliver within an additional period appropriate to the circumstances and, if we still fail to deliver, you may terminate the contract and receive a full refund without undue delay. The risk of loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, take physical possession of the goods.

9. Customs and Import Charges

Because our goods are shipped from outside the European Union, shipments may be subject to import VAT, customs duties or handling fees. Where such taxes or charges are collected at checkout, you will not be asked to pay them again on delivery. Unless they are collected at checkout, any applicable customs or import charges are the customer's responsibility and are payable to the carrier or customs authority. 10. Right of Withdrawal

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the goods (or of the last item, where the goods in one order are delivered separately).

You may use the model withdrawal form available at /pages/right-of-withdrawal-cancellation-form, but it is not obligatory. You can also use the withdrawal function ("withdraw from contract here" button) on our website to withdraw online; if you do, we will send you confirmation of receipt of your withdrawal on a durable medium (for example, by e-mail) without delay. To meet the deadline, it is sufficient to send your communication before the withdrawal period expires.

Effects of withdrawal: we will reimburse all payments received from you, including the costs of standard delivery (except supplementary costs where you chose a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the day we are informed of your decision. We will use the same means of payment you used, and you will not incur any fees for the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied proof of having sent the goods back, whichever is earlier. You must send back the goods without undue delay and no later than 14 days from the day you communicated your withdrawal. You bear the direct cost of returning the goods. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning — for example, trying a garment on as you would in a shop is permitted.

11. Returns and Refunds

Practical instructions for returns, including the return address and processing times, are set out in our Refund Policy. That policy applies in addition to, and never limits, your statutory right of withdrawal (Section 10) and the legal guarantee of conformity (Section 12).

12. Legal Guarantee of Conformity

If you are a consumer in the European Union, you benefit from a legal guarantee of conformity under EU law (Directive (EU) 2019/771, as implemented in your country of residence): we are liable for any lack of conformity that exists at the time of delivery and becomes apparent within a minimum of two years from delivery (some countries provide longer periods). If the goods are not in conformity, you are first entitled to have them brought into conformity free of charge by repair or replacement, at your choice, unless the chosen remedy is impossible or disproportionate. If repair or replacement is not possible, is not provided within a reasonable time or without significant inconvenience to you, you are entitled to a proportionate price reduction or to terminate the contract and receive a refund (termination is not available where the lack of conformity is only minor). All remedies under this legal guarantee are free of charge for you. This legal guarantee is independent of, and applies in addition to, the 14-day right of withdrawal (Section 10) and any commercial return policy, and nothing in these Terms limits it. 13. Promotions and Discount Codes

Promotions and discount codes are subject to the conditions stated when they are offered. Unless stated otherwise, codes cannot be combined, are limited to one per order, and cannot be applied retroactively to orders already placed. We may cancel a promotion or refuse a code in cases of abuse.

14. Gift Cards and Store Credit

Gift cards and store credit are subject to any additional terms presented at the time of purchase or issuance. They can be redeemed on the Site and are not redeemable for cash, except where required by applicable law.

15. Intellectual Property

All content on the Site — including text, images, photographs, logos, graphics and designs — is owned by us or our licensors and is protected by intellectual property laws. You may use the Site for personal, non-commercial shopping purposes only. You may not copy, reproduce or otherwise use our content without our prior written permission.

16. User Comments and Reviews

If you submit comments, reviews or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish that content in connection with our store. Your content must not be unlawful, misleading, defamatory or infringing of third-party rights, and must not contain malware. We may edit or remove content that violates these rules. Where we display customer reviews, we will indicate whether and how we verify that they originate from customers who have actually purchased the product.

17. Third-Party Services

Our store is hosted on Shopify, and we use third-party services such as payment processors, shipping carriers, analytics and advertising partners. These services operate under their own terms and privacy policies. We are not responsible for third-party services that we do not control; this does not limit our responsibility for our own obligations under these Terms or under mandatory consumer law.

18. Prohibited Uses

You may not use the Site: for any unlawful purpose; to infringe our or others' intellectual property rights; to submit false or misleading information; to upload or transmit viruses or other malicious code; to collect or track the personal information of others; to interfere with or circumvent the security features of the Site; or to abuse promotions, discount codes or the withdrawal process in bad faith. We may suspend or terminate your access to the Site for violations of this section.

19. Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages (such as loss of profit, data or goodwill) arising from your use of the Site or our products. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, intent or gross negligence, or for any matter for which liability cannot be excluded or limited under the mandatory consumer protection law of your country of residence, including your rights under Sections 10 and 12.

20. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including customs processing delays, natural disasters, strikes, war, acts of government, carrier disruptions, supply chain interruptions, epidemics, technical failures or payment system outages. Our obligations are suspended for the duration of such an event. If such an event prevents delivery for a prolonged period, either party may cancel the affected order and we will refund all payments received for undelivered goods. This section does not limit your statutory rights, including your rights under Section 8.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. However, if you are a consumer residing in the European Union, you always retain the protection of the mandatory consumer-law provisions of the law of your country of habitual residence, and you may bring proceedings before the courts of that country and may only be sued there, in accordance with the EU consumer rules of the Rome I and Brussels I bis Regulations.

22. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page with an updated "Last updated" date. The version in force at the time you place an order applies to that order. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms for future use.
